Requirements for Statutory Declarations

A statutory declaration must be made pursuant to the legislation applicable in the state or territory in which the declaration is made.

The statutory declaration must:

  • attest that the information provided by the person signing it is true and correct to the best of the person’s knowledge and belief
  • in the case of an individual, provide details of any conviction imposed or finding of guilt in respect of any offence of dishonesty or any indictable offence.
Note: Persons completing a statutory declaration should be aware that in every state and territory, a false statement made in a statutory declaration may be  treated as a severe offence punishable by law. It may also give cause to refuse registration or for de-registration of that person. 

Who must complete the Statutory Declaration?

Company - In the case of a company or organisation, the responsible person named in the registration form who provides the primary information (for the purposes of registration) and each person named in that registration form as a person employed by or under contract to the organisation must provide a statutory declaration.

Individual - In the case of an individual, that person must provide a statutory declaration.
